Wills are an important step in any appropriate estate plan. Wills, among other things, can provide for the transfer of your wealth upon death but can also provide for the care and maintenance of any minor children upon your death. Additionally, wills can make special provisions for elder care benefits, reduction of death taxes, costs and expenses associated with death, and also provide for any loved ones who have special needs.
In the state of Washington, there are certain formalities that must be observed when executing a will – namely, two witnesses and a notary. Wills allow you, subject to community property rights of a spouse, to elect who you want to handle your final affairs, pay final bills and transfer the assets in accordance with your desires.
Wills can also be used for elder care or Medicaid planning for governmental assistance with elderly couples and provide for trusts for children so that they do not receive all assets upon the age of 18, but can have staggered or held-back distributions to ensure there are funds available for health, education, and/or general welfare.
