Estate planning, or deciding on where you wish your assets to go upon your death, is important for your family’s stability, protection of family wealth, charitable giving, and planning for the care of loved ones. Unfortunately, estate planning is also an issue in life that people either choose not to deal with at all or procrastinate until it is too late.

The term “estate planning” encompasses a variety of planning tools. One example of an estate planning tool is a Durable Power of Attorney. A Durable Power of Attorney can be used for both financial and medical decision making in the event one is unable to make those decisions. These are also helpful in avoiding the necessity of establishing a guardianship which can be both costly and time consuming.

Other estate planning mechanisms include wills and/or trusts which provide for transfer of your wealth upon death. There are also planning possibilities in transferring your property without the necessity of probate in certain circumstances; to potentially reduce death taxes which would otherwise be paid needlessly; and, to assuring that minor children are cared for by the persons whom you want, in the way that you want. Additionally, estate planning can be used to assist in obtaining, in the right circumstances, governmental assistance for the elderly.
